Welcome to Everwinders. By accessing or using our platform at everwinders.com, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use the platform.

1. Acceptance of Terms

By creating an account or using any part of Everwinders, you confirm that you are at least 16 years old and agree to comply with these terms. If you are using the platform on behalf of an organisation, you represent that you have the authority to bind that organisation to these terms.

2. User Accounts

You are responsible for maintaining the security of your account and password. You must not share your login credentials with others. You are responsible for all activity that occurs under your account. You must provide accurate and truthful information when registering. We reserve the right to suspend or terminate accounts that violate these terms.

3. Acceptable Use

When using Everwinders, you agree not to post content that is illegal, harmful, threatening, abusive, defamatory or otherwise objectionable. You must not use the platform to distribute spam, malware or phishing content, attempt to gain unauthorised access to the platform or other users' accounts, impersonate another person or entity, or interfere with the proper functioning of the platform.

4. Content

Your Content

You retain ownership of content you submit to Everwinders, including server listings, plugin uploads, articles and comments. By posting content, you grant us a non-exclusive, worldwide licence to display, distribute and promote your content on the platform.

Content Standards

All content must be relevant to the Everwind game and community. Server listings must contain accurate information including valid server addresses. Plugins must not contain malicious code. Articles and comments must be written in good faith.

Content Removal

We reserve the right to remove any content that violates these terms or that we consider harmful to the community, without prior notice.

5. Server Listings

Server owners who list their servers on Everwinders must provide accurate and current server information. They must not manipulate the voting system through bots, alt accounts or other means. They are responsible for the content and conduct on their own servers. Violation of these rules may result in the removal of the server listing and suspension of the associated account.

6. Plugins

Developers who upload plugins to Everwinders must ensure their plugins do not contain malware, backdoors or malicious code. They must have the right to distribute the plugin. They should provide accurate descriptions and version information. We do not guarantee the safety or functionality of any plugin. Users download and install plugins at their own risk.

7. Voting

The voting system is intended to reflect genuine community preferences. Each user may cast one vote per server per day. Manipulating votes through automated means, multiple accounts or vote trading is strictly prohibited and will result in account suspension.

8. Intellectual Property

The Everwinders platform, including its design, code and branding, is our intellectual property. The name "Everwind" and related game assets belong to Enjoy Studio and Bohemia Interactive respectively. Users may not use our trademarks without written permission.

9. Disclaimer of Warranties

Everwinders is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the platform will be uninterrupted, secure or error-free. We are not responsible for the content, accuracy or practices of any listed servers or uploaded plugins.

10. Limitation of Liability

To the maximum extent permitted by law, Everwinders and its operators shall not be liable for any indirect, incidental, special or consequential damages arising from your use of the platform, including but not limited to loss of data, loss of profits or damage to your computer systems.

11. Modifications

We reserve the right to modify these Terms of Service at any time. We will notify users of significant changes through the platform or via email. Continued use of the platform after changes are posted constitutes acceptance of the modified terms.

12. Termination

We may suspend or terminate your access to the platform at any time, with or without cause, with or without notice. Upon termination, your right to use the platform ceases immediately. Provisions that by their nature should survive termination will remain in effect.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of the European Union and the applicable laws of the Slovak Republic.
